Terms of Service

Welcome to AssistPlant. These Terms of Service ("Terms") govern your access to and use of the AssistPlant website, web application, and related services (collectively, the "Service") operated by AssistPlant ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use AssistPlant. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To use the Service, you must create an account using either an email address and password or Google Sign-In. You agree to:
  • Provide accurate and complete registration information.
  • Keep your login credentials secure and not share them with others.
  • Notify us immediately at support@assistplant.com if you suspect unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

AssistPlant is a plant care management application that allows you to:
  • Track indoor and outdoor plants with custom care schedules (watering, misting, fertilizing, pruning, repotting).
  • Receive care reminders via push notifications and email.
  • Log care history and upload plant photos.
  • View a care calendar to visualize upcoming and past tasks.
  • Sync care schedules to Google Calendar (Pro plan).

4. Free and Pro Plans

Free Plan: You may track up to 3 plants with access to core features including care schedules, care calendar, care history, photo gallery, and browser push notifications at no charge.
Pro Plan: The Pro plan offers unlimited plants, Google Calendar integration, email reminders, and additional customization features for a recurring subscription fee. Pricing is displayed in the app and on our website at the time of purchase.

5. Subscriptions and Payments

Pro plan subscriptions are billed on a recurring basis (monthly or yearly) through Stripe, our third-party payment processor. By subscribing, you agree to the following:
  • Free Trial: New Pro subscribers receive a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.
  • Recurring Billing: After the trial (or immediately if no trial applies), your chosen payment method will be automatically charged at the start of each billing cycle.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.
  • Refunds: Subscription fees are generally non-refundable. If you believe you were charged in error, contact us at support@assistplant.com and we will review your case on an individual basis.
  • Price Changes: We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle, and we will notify you in advance.
Payment processing is handled entirely by Stripe. We do not store your credit card number or full payment details on our servers. Please refer to Stripe's Privacy Policy for information about how Stripe handles your payment data.

6. User Content

You may upload content to the Service, including plant names, notes, photos, and care data ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing and improving the Service.
You agree not to upload content that:
  • Infringes on the intellectual property rights of others.
  • Contains malware, viruses, or any harmful code.
  • Is illegal, obscene, defamatory, or otherwise objectionable.
  • Violates any applicable law or regulation.
We reserve the right to remove User Content that violates these Terms.

7. Acceptable Use

You agree not to:
  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated means (bots, scrapers, etc.) to access the Service without our written permission.
  • Interfere with or disrupt the Service or servers connected to it.
  • Create multiple accounts for abusive purposes, including to circumvent plan limits.

8. Intellectual Property

The Service, including its design, logo, code, text, graphics, and other content (excluding User Content), is owned by AssistPlant and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

9. Third-Party Services

The Service integrates with the following third-party services:
We are not responsible for the practices or policies of third-party services.

10. Account Deletion

You may delete your account at any time from your account settings. Upon deletion:
  • All your personal data, plant data, care history, photos, and associated records will be permanently deleted from our systems.
  • Any active subscription will be canceled and your Stripe customer record will be removed.
  • Any connected Google Calendar integration will be disconnected.
  • This action is irreversible. Deleted data cannot be recovered.

11. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service downtime.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
AssistPlant provides plant care scheduling tools and reminders as a convenience. We are not responsible for the health or outcome of your plants. Plant care advice or suggestions provided through the Service are for informational purposes only and should not be relied upon as professional horticultural advice.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASSISTPLANT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify and hold harmless AssistPlant and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AssistPlant operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts in the jurisdiction where AssistPlant operates.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AssistPlant regarding the Service and supersede any prior agreements or understandings.
